Man cleared of raping woman he met at city nightclub
Daniel Matola, 22, had denied assaulting the woman on Bon Accord Terrace in 2016.
A man has been cleared of raping a woman in Aberdeen after she told a police officer that the sex was "probably consensual".
Daniel Matola, 22, denied assaulting the woman during the incident in the city's Bon Accord Terrace on September 9 in 2016.
The Crown alleged he had raped her while she was intoxicated with alcohol and incapable of giving or withholding consent.
But a jury at the High Court in Edinburgh found Matola, of Greig Court, in Aberdeen, not guilty of the charge.
The 21-year-old woman said she had gone to a nightclub with others and had danced with him and kissed him.
She said she did not remember an outgoing message from her phone asking to meet her outside the club.
She said she also did not recall a further message to his phone saying: "Phone me."
A police officer, who was called to the scene in the early hours of the morning, said the woman appeared "extremely intoxicated".
He said when initially asked if sex was consensual she replied: "No."
But when he asked her again a couple of minutes later she said: "Probably, I don't know."
